Model value terms

1. Who we are and when these terms apply

YourNxtHome is a trade name of Provato Playground B.V., registered with the Dutch Chamber of Commerce under number 42042123. You can reach us at support@yournxthome.nl. Our full details are at the end of these terms.

These terms apply to your order of a model value. Where the general terms say otherwise, these terms prevail.

These terms apply to every model value you buy from us separately, also if you buy for your profession or business. What protects consumers only (withdrawal in chapter 5, the statutory rules in chapter 6 and the protection of your country of residence in chapter 10) then does not apply. For an agency that requests a model value under its subscription, the general terms apply.

Your order is governed by the terms as they were at the moment you ordered.

2. What you buy

A model value is an indication of the value of a home on the reference date, calculated by Altum AI's model. Altum AI uses the address and the details you check or adjust before ordering. You get the model value with a range, the characteristics Altum AI used and, if Altum AI provides it, an accuracy indicator. The outcome states which Altum AI model was used.

A model value is not a valuation report and not advice. YourNxtHome does not calculate the value itself and does not assess the outcome. A model value is produced without anyone seeing the home, and may differ from the price a home sells for.

You can request a model value for any residential address, also if you do not live there. Altum AI only receives the address, the reference date and the details in the overview "Basis of this valuation", not your name, email address or payment details.

3. Ordering and payment

The screen shows the price including VAT before you order. You pay with iDEAL. The contract is concluded when your payment has succeeded. You receive a proof of payment with VAT by email.

You do not need an account. We use your name and email address for the confirmation, the proof of payment and the link to your model value.

4. Delivery

Right after your payment we start delivery: we request the model value from Altum AI. You see it on screen, the link in your email takes you there too, and you can download it as a PDF.

If no model value can be made, for example because Altum AI cannot value the address, you automatically get the full amount back to the account you paid from. We tell you by email.

If the screen recognises that you recently bought the same model value with the same details, it shows your saved outcome without a new payment. Otherwise it is a new order; the screen says so before you order.

5. Right of withdrawal

As a consumer buying at a distance you have a right of withdrawal. For a model value it ends as soon as we start the delivery after your payment. When ordering, you expressly ask us to start delivery straight away, even though the withdrawal period is then still running, and you declare that you thereby waive your right of withdrawal (article 6:230p under g of the Dutch Civil Code). You cannot order without that declaration. We confirm your consent and your declaration by email.

Until delivery starts, you can cancel the order by email to support@yournxthome.nl. You then get the full amount back by the same means of payment (article 6:230r of the Dutch Civil Code). The model withdrawal form is below these terms.

6. Questions and complaints

Your model value must conform to the contract. The statutory rules for digital content apply (article 7:50aa and following of the Dutch Civil Code).

If something is wrong with your model value or your order, email support@yournxthome.nl and include your request number.

7. Liability

Decisions you base on a model value are your own. If you want certainty about the value of a home, have it valued by a certified valuer.

If we are liable for damage, it is up to the amount you paid for that model value at most. This limit does not apply in case of intent or gross negligence on our part, nor to your rights if your model value does not conform to the contract (chapter 6).

8. Keeping and reading back

We keep your model value for a period after delivery, so you can read it again through the link in your email or, if you set a password, in your account. How long is stated in our privacy policy. After that we delete it. We keep the payment details as long as the law requires.

Anyone who has the link from your email can see your model value. Only share it with people who may see it. If you have lost the link, create an account with the email address of your order; your model value is there.

9. Use of your model value

The model value and the PDF are for your own use. You may show them to others or pass them on. It then remains an indication from a calculation model, and nobody else can derive rights from it against YourNxtHome or Altum AI. Reselling it or offering it in a service of your own is not allowed.

10. Governing law and disputes

These terms and your order are governed by Dutch law. If you live in another country, you keep the protection that the law of that country gives you as a consumer and that cannot be set aside.

A dispute is submitted to the court that has jurisdiction by law.

If the Dutch and English texts differ, the reading most favourable to you applies.
