Terms and conditions

1. Scope

These terms apply to every offer by YourNxtHome and to every agreement between the platform and a user: an estate agency offering homes, or a visitor searching them. By using the platform you agree to these terms.

Provato Playground B.V., established at Stadionweg 294 H, 1076 PH Amsterdam, registered with the Dutch Chamber of Commerce under number 42042123, VAT number NL869441358B01, is the contracting party in every agreement with users of the platform.

2. The service

YourNxtHome is a platform where estate agencies show their listings and where visitors can search and view that supply. Agencies enter their homes themselves or have them arrive automatically from their own CRM system.

2a. Our role: a platform, not an intermediary

YourNxtHome is an electronic notice board: we bring supply and demand together and make direct contact between parties possible. We do not act as intermediary, agent or representative of a buyer, tenant, seller or landlord. We do not look for parties on each other's behalf and we do not negotiate for anyone.

A purchase, rental or other agreement about a home comes about exclusively and directly between the parties involved. YourNxtHome is not a party to that agreement, and payment for a home does not run through YourNxtHome.

YourNxtHome receives no fee tied to the conclusion, the price or the size of a transaction. Our income consists of fees for platform services, regardless of whether, and at what price, a home is sold or let.

Bidding, negotiating and scheduling a viewing happen outside the platform, directly with the agency offering the home.

3. Account and agency

To offer homes you need an agency account. The owner of the agency can invite colleagues as members. You are responsible for keeping your credentials secret, and everything that happens through your account is your responsibility. If you suspect unauthorised use, contact us immediately.

4. Credits and payments

Certain services are paid for with credits. You buy credits in advance and spend them on platform services. Credits belong to the agency and not to a person: only the owner of an agency buys credits, and all members spend from the same balance.

Payments run through Mollie. The price is always shown before you buy, and spending credits always requires a confirmation. Purchased credits are non-refundable unless the law provides otherwise.

4a. Paid visibility

An agency can have a property featured. The property then gets a frame and the mark "Featured by the agent" on its card in the search results and wherever else that card appears, so that anyone can see this is a paid placement.

Featuring does not change the order of the search results. The sort you choose determines the order, and a featured property does not end up in a list it would otherwise not appear in. The page Order of search results sets out which data does determine the order.

Featuring buys visibility, not a result. We promise no number of impressions, viewings or responses, and how many people see a property depends on what they are looking for.

The term is stated at the point of purchase and starts immediately. Extending adds to the running term and never shortens it.

Featuring is paid for with credits. The price is always shown and spending credits always asks for confirmation first. A term that has started is not refunded. If you take the property offline yourself, the term keeps running. If we remove the property because a report about it is upheld, the featuring stops immediately and is not refunded.

5. Content and liability

The agency offering a home is responsible for the accuracy of the published information. Although we complete address and property data from the Dutch Register of Addresses and Buildings (BAG) where possible, YourNxtHome accepts no liability for inaccuracies in listings.

Where we show a calculated value ourselves, we say what it is. A model value is a calculated indication based on data from comparable homes, produced without anyone seeing the property. It is not a valuation and has no legal status.

6. Order of search results

The order of homes in the search results depends on what you search for and on the sorting you choose. Paying does not buy a better position, and positions are not auctioned. YourNxtHome offers no homes of its own, so there is no own supply that we could favour.

An agency can buy paid visibility for a property: it then gets a frame and a mark on its card. Such a placement is recognisable as such and stands apart from the search results. It does not change the order and does not add a property to a list it would otherwise not be in. The page Order of search results sets out which data determines the order and which expressly does not.

7. Intellectual property

All rights to the platform, the software, the design and the content created by YourNxtHome belong to Provato Playground B.V. By uploading content you give us permission to show it on the platform and in promotional material.

8. Reporting, review and termination

You can delete your account at any time through your account settings. We reserve the right to suspend or delete accounts in case of a breach of these terms, fraud or other misuse.

Reporting. If you believe content on the platform is illegal or contrary to these terms, you can report it through the report button at the bottom of any property page. No account is needed. We ask for your email address so we can send you the decision.

Review. Reports are reviewed by a person. We do not use automated means to assess or remove content. The reporter is informed of the decision, including where the report is not followed.

If we restrict content. If we take a home offline or restrict use of the platform, you receive a reasoned statement: what the decision is, on which facts and on which ground it rests, that no automated means were used, and what you can do about it. You can always respond at support@yournxthome.nl, go to court, and lodge a complaint with the Netherlands Authority for Consumers and Markets.

9. Governing law

These terms are governed by Dutch law. Disputes are submitted to the competent court in Amsterdam.
